Memorandum to the Chief Justice of Pakistan on "Crimes against Humanity" and Genocide committed by Pakistan Army and its subordinate agencies including F.C in Baluchistan.

Subject: Charge Sheet and Trial Pakistan Army's Present and Ex. Chief
for their Army's Crimes against Humanity and Genocide in Baluchistan

1. After having a detailed review of the history of conflict in
Baluchistan since 1948, especially of the events occurred during last
eight years, and after keenly observing the proceedings of the
honorable Supreme Court of Pakistan during April-May 2012 regarding
several petitions about the forced disappeared Baluchs, February 18,
2012 incidence of Baghbana, District Khuzdar, Law and Order situation,
Ransom Kidnappings, Sectarian Killings and Murdr of the sister and
niece of Mr Brahmdagh Bugti, Leader of Baluchistan Republican Party in
Karachi on January 30,2012, this Memorandum is being sent to you with
an objective to invite the attention of the honorable Apex Court of
Pakistan towards identification of the organized crimes being
reported from Baluchistan for as many as eight consecutive years, as
"Crimes Against Humanity" and "Genocide" as they actually fall in
these categories according to the Rome Statue.

2. This memorandum also intends to invite the kind attention of the
honorable Apex Court to some important yet ignored facts, legal and
moral aspects of Baluchistan's Crisis which are critical for
dispensation of Justice to the victims of the Crimes against Humanity
and Genocide. It is feared that if the honorable Court continues
ignoring these facts, as it used to for years, it won't be virtually
possible for the Court to fulfill her very responsibility regarding
the matter mention in the subject line.

3. This memorandum is also meant to make prayer before the honorable
Apex Court to hold the Chief of Army Staff of Pakistan, his associates
in process of policy and decision making, the ex Chief of the
aforesaid force and his allies in policy and decision making
responsible for the Crimes against Humanity and Genocide carried out
by their forces during last 8 years in Baluchistan. The COAS must be
effectively stopped from committing more crimes of the same nature and
due course of legal action in compliance with the provisions of basic
human rights vested in constitution of Pakistan and the International
precedents regarding the crimes of the same nature be initiated
immediately.

4.  Baluchistan has been undergoing "CIVIL WAR" for several years till today.
5. Pakistan Army has been operating in Baluchistan as "De facto
Authority" in Baluchistan for at least 12 last years. Its Chiefs and
their associates have been solely responsible for devising policies,
planning and implementing the operations regarding the so-called
counter insurgency in Baluchistan without any interference from the
Federal and Provincial Governments for at least last ten years.

5. Pakistan Army, its subordinate agencies and F.C, the Para military
force practically controlled by Pakistan Army, for several years have
been at logger heads with several "Armed Baluch Liberation
Organizations” which claim to be struggling for liberation of their
motherland from Pakistani state.

6. All the Armed Baluch Liberation Organizations comprising just a few
thousand members use Guerrilla Warfare methods to revolt the authority
of Pakistani state in Baluchistan. Their members "hit and run away" in
to the mountains and barren lands for hiding. Usually they have
nothing to do with the civilian Baluch populous.

7. Several Baluch Political Parties and Student Organizations in
Baluchistan have been struggling for several years in quite a peaceful
and democratic manner for the "Right to Self Determination" and other
rights including political, cultural and economic rights of the Baluch
people. These political parties and students organizations enjoy
popular support in Baluchi and Brahvi speaking areas of Baluchistan.

8.Pakistan Army and its subordinate agencies and Para-military forces
controlled by  it have been found involved in persecution of the
members, supporters and sympathizers of the aforesaid Baluch political
parties and students organizations by conducting the organized crimes
that fall either in category of "Genocide" or/and "Crimes against
Humanity" according to the Rome Statue. Officially it has been claimed
that the forces aforesaid had been carrying out lawful activities to
maintain "law and order" or to search and nab the "out-laws" in
Baluchistan, but behind this smoke screen, the aforesaid forces have
committed thousands of organized crimes against a specific political
group of the Baluch Nation aimed at either to force them to withdraw
from their political views, affiliations and sympathies or to simply
destroy them physically and psychologically.Thousands of organized crimes  committed by Pakistan army and its subordinate agencies committed against the aforesaid Baluch political group include;

•  Murders
• Forced displacement
• Forced disappearances
• Extermination
• Extreme physical and mental torture
• Illegal detentions and severe deprivation of physical liberty in violation of fundamental rules of international law
• Setting houses and properties ablaiz

9. More than two hundred thousand Baluchs, almost all belonging to the
specific political group mentioned above, have directly been hit
by the Crimes against Humanity and Genocide committed by Pakistan Army
during last eight years.

10. Several petitions from the Baluch victims of the crimes mentioned
above have lodged complaints/petitions with the law enforcing
authorities including the courts of law demanding justice but none of
the culprits could be brought to justice yet. This is actually a
common feature of the "Crimes against Humanity" and Genocide occurred
in past 65 years around the globe that the law enforcing agencies and
the courts working under authority of the same State, fail to deliver
justice to the victims of the state of a de facto authority operating
in the state.

11. Though the honorable Apex Court of Pakistan has recovered some of
the forced disappeared Baluchs from custody of the civilian state
institutions i.e. Police during this period but none of the culprits
could be dragged to justice yet due to lack of interest on part of the
institutions responsible for dispensation of justice.

12. The honorable Supreme Court of Pakistan is requested to identify
the cases of "forced disappearance" of Balochs as a component of
Pakistan Army's policy  devised to crush resistance posed by a
specific political group of the baluchs as there are sufficient
evidences to believe so. these cases along with other organized crimes
by the same against the group aforesaid should be seen in light of the
article 6, 7 and 28 of the Rome Statue and be proceeded by the Apex
Court as "Crimes against Humanity" and "Genocide". These cases due to
their special nature need special treatment.

13. The Supreme Court may direct the Chief of Army Staff of Pakistan
Army to produce all the forced missing persons before the court
within a certain period of time fixed by the honorable court i.e one
month. On expiry of this time, the honorable court must start legal
proceedings under charge of kidnapping and murder in illegal custody
against him and others found involved in decision making regarding
kidnapping of thousands of persons over the span of years.
Precedence’s from abroad may be followed in absence of appropriate
laws for criminal proceedings regarding "Crimes against Humanity" and
"Genocide".

Islamic Terrorists Ultimately Demolish Danish Embassy in Islamabad?

Islamic Extremists in Pakistan ultimately succeed in hitting Danish Embassy today on June2, 2008.According to local News TV Channel's' reports at least 9 people were killed and 30 injured in the car-bomb blast in front of Danish Embassy this noon. According to initial estimates, more that 30 kg of highly dangerous explosive was used in this attack. Target was the Danish Embassy but the Project Office of UNDP, situated in front of the Danish Embassy was almost completely demolished while Indian Embassy's Guest House was also damaged. Almost all vehicles parked in Danish Embassy and UNDP office were destroyed. Anjum Masood, a field operations manager for the UN-funded group, Devolution Trust for Community Empowerment, said dozens of its 100 employees were wounded, mostly by flying glass. His own left hand was bandaged.

This deadly Car-bomb blast follows a bombing in March at a restaurant in Islamabad that killed a Turkish aid worker and wounded at least 12 others including four FBI personnel.

Danish Embassy in Islamabad is situated in a residential Sector F 6/2, a few kilometers away from the "diplomatic Enclave" where offices of most of the foreign missions and Embassies are situated.Norwegian Government after this attack on Danish Embassy has closed its Embassy in Pakistan which was operating in the same residential locality of Islamabad.

After receiving threats from Islamic Militant Groups the Danish Embassy In Islamabad had limited its activities to the least extant. Islamic Militant Groups and almost all the right wing political groups had been demanding of the Government of Pakistan to close Danish Embassy in Islamabad. In April, Denmark briefly evacuated staff from its embassies in Algeria and Afghanistan because of terror threats related to the Muhammad drawings. Foreign Minister Per Stig Moeller then suggested Danish embassies in other locations also could be forced to relocate their staff following a warning in March by al-Qa'ida leader Osama bin Laden.

According to initial reports it was apparent that there was no enough security provided to the Danish Embassy since the car loaded with huge explosive could reach in front of the Embassy without any hindrance. Though the local Administration and security personal claim that every vehical moving in to the area where Danish Embassy was situated was checked by the Local security staff but today's attack denies this claim.

Who is Responsible for this attack?
There was no immediate claim of responsibility for the blast. But i fear this act of terrorism was conducted by banned Lashkar-e-Tayba or some other Islamic Militant Groups which may not directly related to the Al-Qaida.

Formed in 1990 in the Kunar province of Afghanistan, the Lashkar-e-Toiba (Now known as Jama’at-ud-Da’awa) is based in Muridke near Lahore in Pakistan and is headed by Hafiz Muhammad Saeed. Its first presence in Jammu and Kashmir (J&K) was recorded in 1993 when 12 Pakistani and Afghan mercenaries infiltrated across the Line of Control (LoC) in tandem with the Islami Inquilabi Mahaz, a terrorist outfit then active in the Poonch district of J&K.
Proscription

The LeT is outlawed in India under the Unlawful Activities (Prevention) Act.
It was included in the Terrorist Exclusion List by the US Government on December 5, 2001. The US administration designated the Lashkar-e-Toiba as a FTO (Foreign Terrorist Organization) on December 26, 2001. It is also a banned organization in Britain since March 30, 2001.

The military regime of Gen. Pervez Musharraf banned the Lashkar-e-Toiba in Pakistan on January 12, 2002.Since then it has been operating in Pakistan with a new name" Jamat-al-Dawath". The groups activities in Pakistan include mass mobilisation on Jihad against Non Muslims. Its focus has been on Jihad in Indian occupied Kashmir but in a recent report The US authorities have blamed it for sending militants in Iraq too.The USA Government just a few days earlier had announced to seize accounts of the three top leaders and a financier of Lashkar-e-Tayba on the charges of involvement in terrorism.

During recent months this group merged as the biggest campaigner against Denmark for her firm stance to protect the freedom of expression in context of the controversial sketches of Mohammad, the founder of Islam. According to the official weekly newspaper of Jamat-al-Dawath,(April11-17) the group had conducted 10,697 public meetings in 26 districts of Pakistan to project the issue of "Respect of the Prophet(Mohammad)". In Lahore only, the capital city of Punjab Province, the group organized 1346 public meetings,72 huge hording boards and 4500+ street walls in the city was used to proliferate hatred against those who don't respect the founder of Islam. " We will sacrifice our lives to protect the Honor of Prophet(Mohammad)" was the slogan painted on the hording boards and the walls while one hundred and fifty thousand stickers were also pasted all around in the city by this group bearing the same slogan. Same activity was carried out by the activists of this group in other cities of Punjab and other parts of Pakistan as well.

The Group's leader Hafiz Saeed, responding to the recent move by the US government said that his group had no accounts in America so our activities will not afect by such an actions. Though formally banned by the Government of Pakistan in 2002, the leadership of Lashkar-e-Tayba had never faced anu hardships in carrying out its activities including running its training facilities mainly in Punjab and Pakistan's held Kashmir. This is largely believed in Pakistan that this group now called Jamat-al-Dawath is being supported and facilitated by Pakistan Army's Inelegance Agencies for it provides Mujaheddin to fight in Kashmir. This group also supports the Military Establishment by proliferating Islamic Militancy and ideas like Jihad which ultimately give legitimacy to the huge expanses on Military in a poor country.

The reason for suspecting Jamat-Al-Dawath or Lashkar-e-Tayba is quite understandable. By its recent declaration regarding LeT, The US government sent a message to the Military Establishment of Pakistan that their allies' activities in Pakistan will now be checked in a different manner. Lose security of the Danish Embassy which was the most Hard Target of the Islamic Terrorists in Pakistan also provides room for suspicions that the authorities responsible for provision of security could also be involved in this heinous act of terrorism. In the most discussed assassination of Benazir Bhutto, the leader of Pakistan Peoples Party, security flaw of the same same nature provided the terrorists a vital opportunity to finish BB who was out to deprive the Military of power in Islamabad. BB had sent a message to one of her friends abroad on the same day when she was assassinated that if she was killed, Musharraf the President of State will be responsible for that.

Like other nations, balochs also have right to quit federation of pakistan as they are treated just like slaves by the punjabi establishment who dominates Pakistan Army, Pakistan Civil sirvices and even all the mainstream political parties. Baloch people have been deprived of their democratic rights since long and now they are facing wors ever catestrophy at the hands of pakistan army. thousonds of young Balochs are missing since last three years. this is believed that pakistan army's inteligence agencies have kidnaped them and no one knows whether they are alive yet or not. Baloch nation has left with no way except fighting for their survival. their movement for indipendence is just and all the freedome lovers around the globe should support them.
